🍌 BANANABOY / LEGAL
TERMS &
CONDITIONS.
The rules of the banana jungle. These terms explain how BananaBoy.ca's website and creative services are intended to work.
Acceptance of these terms
These Terms and Conditions govern your use of BananaBoy.ca and any design, web, branding, graphic design, content, digital marketing, creative direction, audit, or related services supplied by BananaBoy.ca.
By using this website, contacting BananaBoy.ca, requesting a quote, or engaging BananaBoy.ca for services, you agree to these terms. If you are entering into a separate written proposal, estimate, statement of work, or service agreement with BananaBoy.ca, that agreement will also apply and will control where it conflicts with these general website terms.
Our services
BananaBoy.ca provides creative and digital services that may include branding, logo and identity design, website design and development, graphic design, social content, digital advertising, packaging, creative direction, content and copywriting support, and design audits.
Project scope, deliverables, timelines, revisions, fees, payment schedules, third-party costs, and other project-specific requirements should be confirmed in writing before work begins.
Quotes, approvals & project changes
Quotes and estimates are based on the information available when they are prepared. A project may change in price or timeline if its scope changes, additional functionality is requested, content is delayed, or new requirements are introduced after approval.
You are responsible for reviewing and approving project materials, supplying accurate information and content, and providing timely feedback. Approval of a design, proof, copy, or other deliverable means BananaBoy.ca may proceed based on that approval.
Fees & payments
Fees, deposits, milestones, retainers, taxes, and payment deadlines will be established for each project. Unless a project agreement states otherwise, third-party expenses such as domains, hosting, premium software, stock assets, plugins, fonts, advertising spend, printing, or external development services may be charged separately.
Work may be paused when invoices are overdue. Additional costs resulting from delays, scope changes, rush requests, or work outside the agreed scope may be invoiced separately.
Intellectual property
BananaBoy.ca retains ownership of its original working files, unused concepts, internal processes, templates, tools, and materials unless a written agreement states otherwise.
Upon full payment for a completed project, the client receives the rights specifically granted in the project agreement for the final deliverables. Third-party materials remain subject to their own licences and restrictions.
BananaBoy.ca may display completed work in its portfolio, website, social channels, case studies, awards submissions, or other promotional materials unless the parties agree in writing that the work is confidential.
Acceptable use
You agree not to use this website or BananaBoy.ca services for unlawful, fraudulent, abusive, defamatory, infringing, harmful, or malicious purposes. You must not attempt to interfere with the website, introduce malicious code, gain unauthorized access, scrape or reproduce protected material in a way that violates applicable law, or misuse any communication or submission form.
Third-party services & links
Projects may depend on third-party platforms, hosting providers, domain registrars, payment processors, advertising platforms, software, plugins, fonts, APIs, or other services. BananaBoy.ca does not control third-party services and is not responsible for their availability, policies, pricing, security, or changes.
Links to third-party websites are provided for convenience and do not constitute an endorsement or guarantee of those websites or their content.
